All rentals are subject to the following Terms and Conditions.
1. DRIVER ELIGIBILITY & REQUIREMENTS
1.1 The vehicle may only be driven by the individual(s) declared at the time of booking and approved by Ace Car Company Ltd.
1.2 All drivers must be at least 22 years of age at the start of the rental period.
1.3 The Company reserves the right to refuse rental or restrict vehicle use where the driver does not meet the eligibility requirements or where documentation is deemed insufficient.
1.4 The use of the vehicle by any unauthorised or underage driver will result in a breach of these Terms and Conditions and may lead to the voiding of any applicable insurance coverage, with the Renter being held fully liable for all resulting damages and costs.
1.5 The Renter is responsible for ensuring that all authorised drivers comply with these Terms and Conditions at all times. Any breach by an authorised driver shall be deemed a breach by the Renter.
2. PAYMENT
2.1 Payments by cheque or coins in foreign currencies are not accepted.
2.2 A 4% processing fee applies to all credit card transactions, including rental charges, deposits, optional extras, and any applicable damage or administrative fees.
3. INSURANCE
3.1 The company offers Standard cover : No deposit is required at the time of delivery or collection. In the event of damage or accident, the Renter remains liable for an excess ranging from Rs. 25,000 to Rs. 45,000, as determined by the insurer.
3.2 Where insurance has been arranged through a third-party provider, the Renter remains responsible for settling any applicable excess or damage costs directly with Ace Car Company Ltd. Reimbursement, if applicable, must be pursued independently by the Renter with their insurer.
4. DELIVERY & COLLECTION
4.1 Vehicle delivery and collection at the airport is free of charge.
4.2 Vehicle delivery and collection across the island may be arranged at an additional cost.
4.3 Any amendments to the scheduled delivery or collection time or location must be communicated at least 48 hours in advance via email or WhatsApp.
4.4 No refunds or adjustments will be made for delayed collection or early return of the vehicle.
5. FUEL POLICY & VEHICLE CONDITION
5.1 Vehicles are provided under a “same-to-same” fuel policy and must be returned with the same fuel level as at the time of delivery or collection.
5.2 Any discrepancy in fuel level may result in refuelling charges at the Company’s applicable rates.
5.3 The vehicle must be returned in the same condition as delivered, fair wear and tear excepted. Any damage or excessive soiling may result in additional charges.
6. CHILD SEATS AND BOOSTERS
6.1 Child seats and booster seats may be provided upon request, subject to availability and applicable charges.
6.2 The Renter is solely responsible for ensuring that any child seat or booster seat is properly installed, secured, and used in accordance with manufacturer guidelines and applicable safety regulations.
6.3 Ace Car Company Ltd accepts no responsibility or liability for improper installation, incorrect use, or failure to use such equipment.
6.4 By accepting a child seat or booster seat, the Renter acknowledges full responsibility for its correct fitting and use, and agrees that Ace Car Company Ltd shall not be held liable for any injury, loss, or damage arising from its use, including in the event of an accident.
7. ACCIDENTS & FINES
7.1 Any accident or incident must be reported to the Company immediately, and no later than one (1) hour after occurrence.
7.2 In the case of minor incidents, the “Agreed Statement of Facts” form (available in the vehicle) must be duly completed and submitted within 24 hours.
7.3 Failure to comply with reporting requirements may result in the Renter being held fully liable for all resulting costs, including the full insurance excess.
7.4 Where the vehicle is rendered unroadworthy, a replacement vehicle of a similar category may be provided, subject to availability. The Company reserves the right to decline such provision.
7.5 From the time of delivery or collection, the vehicle remains under the full responsibility of the Renter. Any loss or damage, whether caused directly or indirectly, including while the vehicle is unattended or parked, shall be borne by the Renter.
7.6 No spare keys are provided. The loss or damage of keys will incur full replacement and associated costs.
7.7 The Renter is solely responsible for all traffic violations, fines, penalties, and related administrative charges incurred during the rental period.
8. MODIFICATIONS AND CANCELLATIONS
8.1 No refunds will be issued in the event of early return of the vehicle.
8.2 Requests to extend the rental period must be made at least 48 hours prior to the scheduled return time.
8.3 Extensions are subject to availability and may be charged at revised rates.
8.4 All booking modifications and extensions remain subject to availability and confirmation by the Company.
8.5 In the event of any modification, the revised booking details shall supersede the original agreement.
8.6 Cancellations made at least 48 hours prior to the scheduled pick-up time are eligible for a full refund without processing fees.
9. USE OF VEHICLE
9.1 The vehicle must be used in a responsible and lawful manner at all times.
9.2 The following uses are strictly prohibited:
- Driving under the influence of alcohol, drugs, or any substance impairing ability
- Use of the vehicle for illegal activities
- Subletting or re-renting the vehicle
- Use of the vehicle for racing, off-road driving, or any form of competition
- Carrying passengers or goods beyond the vehicle’s permitted capacity
9.3 Any breach of the above conditions may result in immediate termination of the rental agreement, without refund, and full liability for any resulting damage or loss.
10. LIABILITY
10.1 To the fullest extent permitted by law, Ace Car Company Ltd shall not be held liable for any indirect, incidental, or consequential loss or damage, including but not limited to loss of time, inconvenience, or loss of personal belongings.
10.2 The Company shall not be responsible for any items left in the vehicle at any time during or after the rental period.
10.3 The Renter agrees to indemnify and hold Ace Car Company Ltd harmless against any claims, damages, or liabilities arising from the use or misuse of the vehicle during the rental period.
11. DISPUTES & GOVERNING LAW
11.1 The Company is committed to resolving any concerns in a prompt and amicable manner.
11.2 In the event that a resolution cannot be reached, all disputes shall be subject to the exclusive jurisdiction of the courts of Mauritius.
